Dialed Macros – Terms of Service

1.Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement.

2.Description of Services

Dialed Macros provides AI-generated meal plans, recipe suggestions, grocery lists, and nutritional recommendations tailored to your individual inputs, including fitness goals, dietary preferences, and training schedule. The Services are designed to assist with meal planning and are for informational purposes only.

3.User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4.Free Trial

We may offer a free trial period for new users. At the end of the trial, your account will revert to the free tier unless you voluntarily subscribe to a paid plan. No credit card is required to start a free trial. We will not automatically charge you when the trial ends.

5.Subscription and Billing

Dialed Macros offers paid subscription plans that provide access to premium features:

• Recurring billing: Subscriptions renew automatically on a monthly or annual basis, depending on the plan you select
• Payment processing: All payments are securely handled by Stripe. We do not store your full credit card details
• Price changes: We may adjust pricing with at least 30 days' notice before the change takes effect. Continued use after a price change constitutes acceptance
• Failed payments: If a payment fails, we may retry the charge and/or suspend access to premium features until the balance is resolved
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle, and you will retain access to paid features until then

6.Acceptable Use

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights
• Distribute, reproduce, or resell content generated by the Services without authorization
• Attempt to reverse-engineer, decompile, or access the source code of the Services
• Interfere with or disrupt the integrity or performance of the Services
• Use automated scripts, bots, or other means to access the Services in a manner that exceeds normal usage
• Impersonate another person or misrepresent your affiliation with any entity
• Upload malicious code, spam, or harmful content

7.Nutrition Disclaimer

All meal plans and nutritional information provided through the Services are generated based on user-provided data and AI algorithms. They are intended for general informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider or registered dietitian before making any significant changes to your diet, especially if you have underlying health conditions, allergies, or are pregnant or nursing.

8.AI-Generated Content

Meal plans, recipes, and recommendations are generated by artificial intelligence. While we continuously refine our models for accuracy, we cannot guarantee that all generated content will be complete, error-free, or suitable for every individual. You are ultimately responsible for verifying that any plan aligns with your personal health needs and dietary requirements.

9.Intellectual Property

All content, branding, software, design, text, graphics, and other materials available through the Services are the property of Dialed Macros or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any portion of the Services without prior written consent.

You retain ownership of any personal data and inputs you provide. By using the Services, you grant us a limited, non-exclusive license to use your inputs solely for the purpose of generating and delivering your meal plans and improving the Services.

10.Disclaimers and Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any content will be accurate or complete. Your use of the Services is at your sole risk.

11.Limitation of Liability

To the fullest extent permitted by applicable law, Dialed Macros and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Services. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12.Indemnification

You agree to indemnify, defend, and hold harmless Dialed Macros and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13.Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will remain in effect.

14.Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

15.Dispute Resolution

Before initiating any formal legal proceeding, you agree to first contact us at support@dialedmacros.com and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, either party may pursue resolution through the courts as described in the Governing Law section above.

16.Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and notify users via email or an in-app notification. Your continued use of the Services following any changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Services.

17.Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, Cookie Policy, Security Policy, and Refund Policy, constitute the entire agreement between you and Dialed Macros regarding your use of the Services and supersede all prior agreements or understandings.
